Terms of Service

Please read these terms carefully before using MyQeja

1. Agreement to Terms

By accessing or using the MyQeja mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the App.

These Terms apply to all visitors, users, and others who access or use the App, including property seekers ("Clients") and property agents ("Agents").

2. Description of Service

MyQeja is a property listing platform that connects property seekers with verified property agents in Kenya. Our services include:

  • Property listing and search functionality
  • Booking system for property viewings
  • Agent verification and rating system
  • Secure payment processing for viewing fees
  • Communication tools between clients and agents

We reserve the right to modify, suspend, or discontinue the service at any time without notice.

3. User Accounts

Account Registration:

  • You must provide accurate, complete, and current information
  • You are responsible for maintaining the confidentiality of your account
  • You must be at least 18 years old to create an account
  • One person may not maintain multiple accounts

Account Responsibilities:

  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized use
  • We may suspend or terminate accounts that violate these Terms

4. Agent Requirements

To register as an Agent on MyQeja, you must:

Verification Requirements:

  • Provide valid government-issued identification (National ID or Passport)
  • Submit your KRA PIN for tax compliance verification
  • Provide proof of authorization to list properties
  • Complete our agent verification process

Agent Obligations:

  • List only properties you are authorized to market
  • Provide accurate property information and photos
  • Respond to booking requests within 24 hours
  • Attend scheduled viewings or cancel with 24 hours notice
  • Maintain professional conduct with all clients

Violation of these requirements may result in account suspension or termination.

5. Booking and Payments

Viewing Fees:

  • A viewing fee of KES 1,500 is charged per property viewing
  • Fees must be paid in advance to confirm a booking
  • Payment is processed securely through Paystack

Fee Distribution:

  • KES 1,000 is paid to the agent upon successful viewing completion
  • KES 500 is retained as a platform service fee

OTP Verification:

  • Viewings must be confirmed via OTP verification
  • The client receives an OTP that must be provided to the agent
  • OTP verification confirms physical attendance at the viewing

Cancellation Policy:

  • Cancellations made 24+ hours before viewing: Full refund
  • Cancellations made within 24 hours: No refund
  • Agent no-show: Full refund plus compensation credit

6. Token System

Booking Tokens:

  • Users may purchase tokens in advance for property viewings
  • Each viewing requires 1 token (equivalent to KES 1,500)
  • Token packages offer discounts for bulk purchases

Token Packages:

  • 1 token: KES 1,500
  • 3 tokens: KES 4,050 (10% discount)
  • 5 tokens: KES 6,500 (13% discount)
  • 10 tokens: KES 12,500 (17% discount)

Token Policy:

  • Tokens are non-refundable once purchased
  • Tokens do not expire
  • Tokens cannot be transferred between accounts

7. Property Listings

Listing Requirements:

  • All listings must represent actual properties available for rent or sale
  • Photos must accurately represent the property
  • Pricing information must be current and accurate
  • Location information must be precise

Prohibited Listings:

  • Properties you are not authorized to list
  • Fraudulent or misleading listings
  • Properties with disputed ownership
  • Illegal or restricted property types

We reserve the right to remove any listing that violates these Terms.

8. User Conduct

You agree NOT to:

  • Use the App for any unlawful purpose
  • Post false, misleading, or defamatory content
  • Harass, threaten, or abuse other users
  • Attempt to gain unauthorized access to the App
  • Interfere with the proper functioning of the App
  • Scrape or collect user data without permission
  • Use automated systems to access the App
  • Circumvent any security measures

Violation of these rules may result in immediate account termination.

9. Intellectual Property

MyQeja Ownership:

  • The App and its original content are owned by Ombeni Faraja
  • Our trademarks, logos, and brand features are protected
  • You may not use our intellectual property without permission

User Content:

  • You retain ownership of content you post (photos, descriptions)
  • You grant us a license to use your content for service operation
  • You warrant that you have rights to all content you post

10. Limitation of Liability

Disclaimer:

  • The App is provided "as is" without warranties of any kind
  • We do not guarantee the accuracy of property listings
  • We are not responsible for agent or client conduct
  • We do not guarantee successful property transactions

Limitation:

  • Our liability is limited to the amount paid for services
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for third-party services or content

You use the App at your own risk.

11. Indemnification

You agree to indemnify and hold harmless Ombeni Faraja, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you post on the App

12. Dispute Resolution

Governing Law:

  • These Terms are governed by the laws of Kenya
  • Any disputes shall be resolved in Kenyan courts

Dispute Process:

  • Users should first contact customer support
  • We encourage resolution through our internal processes
  • Formal disputes may be escalated to arbitration
  • Class action lawsuits are waived

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. We will notify users of significant changes through:

  • In-app notifications
  • Email notifications
  • Updated "Last Modified" date

Continued use of the App after changes constitutes acceptance of the new Terms.
